INVIS CYCLING
General Cycling Service Policy
Thank you for choosing the services of “INVIS CYCLING” and “TEAM INVIS” (hereinafter collectively referred to as INVIS). All services provided by INVIS, including cycling training, events, rentals, retail, or any related services, are provided subject to these Terms and Conditions.
By registering an account, confirming a booking, paying full or partial fees, or actually participating in any services, you acknowledge that you have read, fully understood, and agreed to be bound by these terms and the specific terms of each service.
Even if you have not completed the account registration process, any form of transaction or participation shall be deemed as your acceptance of all contents of these terms. If you do not agree, please do not make any payment or use the services of INVIS.
Customers have the responsibility to carefully read the contents of these terms (including but not limited to provisions regarding service expiry dates, coach assignment, and administrative fees for changes) before making any payment.
1. Basic Terms and Conditions
- Services provided under the names “INVIS CYCLING” and “TEAM INVIS” are managed and operated by “INVIS HK COMPANY LIMITED” (hereinafter referred to as “INVIS“).
- To ensure service quality and customer safety, cycling training and educational services provided by INVIS are, in principle, only available to customers with a registered account (except as specified in Clause 4 of these terms), with the exception of specific retail, single-session rentals, or promotional activities.
- Unless otherwise specified, INVIS general services are open to individuals aged 4 to 59. For applicants under the age of 4, INVIS will consider and decide on a case-by-case basis (considering factors such as the participant’s physical fitness and equipment suitability). Different services (such as professional training, online shopping, or equipment rental) may have different restrictions on the number of participants, age, or health conditions; please refer to the specific service prospectus for details. Customers over the age of 59 must sign a written liability waiver before they can register for, participate in, or use the relevant services. INVIS reserves the final right to refuse any person’s participation in specific activities based on safety considerations.
- INVIS may provide services to individuals invited by “Group Clients” in any form (including but not limited to verbal invitations, advertisements, or flyers) who have not registered an INVIS account (including but not limited to members, staff, or customers of the “Group Client”). However, the “Group Client” must assume all legal liabilities arising from such individuals’ participation and must represent INVIS in explaining the terms of service, risks, and the “Personal Information Collection Statement” to the participants. They must also ensure that participants confirm they have read, understood, and agreed to INVIS‘s terms of service and risks, and are willing to provide their personal data (including but not limited to name, date of birth, identity documents, and contact methods) and the “Physical Fitness and You Form.”
- By submitting an account registration, service application, or paying full or partial service fees to INVIS (whether via cash, transfer, online shop order, or any other form, and regardless of whether a written application was submitted), the customer represents that they have carefully read, understood, and agreed to accept these Terms and Conditions, as well as other terms issued by the company from time to time (including but not limited to provisions on service expiry dates, coach assignment arrangements, and administrative fees for service changes).
2. Account Policy
- INVIS customer accounts are primarily divided into the following two categories:
- Personal Account (Owner is an Individual Customer): We welcome any individual to register in their own name. Customers under the age of 18 must be registered by a “Contact Person” aged 18 or above; this “Contact Person” will simultaneously be registered with an independent account and shall be responsible for managing bookings for the minor customer and accepting various INVIS service terms on their behalf.
- Group Account (Owner is a Group Customer): We welcome any organization, company, or group to register. A Group Account must register at least one “Contact Person” for management purposes; this “Contact Person” will simultaneously be registered with an individual account.
- TEAM INVIS Membership Application Guidelines:
- TEAM INVIS membership is strictly by invitation only and is limited to individuals invited by INVIS.
- Applicants must already possess a valid INVIS “Personal Account” to proceed with membership registration.
- Upon successful registration, INVIS will issue a confirmation notice and assign a unique “Customer Number.” Customers must safeguard their login information and passwords. Any bookings, purchases, or service applications made through the account shall be deemed the true intent of the account owner. INVIS shall not be held liable for any data loss or legal responsibility resulting from account unauthorized access or leakage.
- Registered customers may notify INVIS to update information or apply for account cancellation at any time in writing or by completing the “Customer Information Update Form.” Any changes to personal data should be notified to INVIS within 7 days of the change.
- Membership Termination and Compensation: Members holding a “TEAM INVIS” membership may apply to terminate their membership. However, please understand that all membership annual fees, training fees, or administrative fees paid are non-refundable under any circumstances. If membership is terminated before the expiry date, the customer may be required to compensate INVIS for relevant losses in accordance with specific regulations.
- To register an account, modify information, or process service applications, please log in to the INVIS Online Customer Service System (system.invis.hk) or complete and return the designated forms.
- INVIS reserves the final right to refuse or terminate any account or membership registration application. For detailed rules regarding account registration, please refer to the relevant service prospectus.
3. Registration and Service Booking Policy
- Account Requirement: All cycling training and instructional services (except for cycling performances, cycling simulator activities, and cycling seminars) must be applied for through a registered INVIS account.
- Booking and Payment: All services must be booked and paid for in full in advance. All purchased services (such as lesson hours, packages, etc.) are subject to a specified validity period. Any services not used within the period will automatically expire and become void, with no refunds or transfers allowed. If payment is not completed before the specified deadline, the booking will be automatically cancelled.
- Coach Assignment: A booking becomes officially effective once INVIS issues a confirmation notice. Except for specific premium items with additional fees, coaches for all services are assigned solely by INVIS; INVIS reserves the right to change coaches at any time without prior notice.
- Health Declaration Obligation: Upon applying for services and making payment, the customer guarantees and declares that they (or the student they represent) are in good physical condition and fit to participate in relevant cycling activities. The health status of participants under 15 years old shall be assessed by their parents or guardians. Although INVIS does not mandate the submission of a written health certificate, it reserves the right to request participants to provide a doctor’s certificate or the “Physical Fitness and You Form.” INVIS shall not be held liable for any accidents resulting from the customer’s concealment of medical history.
- Quotas and Cancellation: Quotas for all services are limited and handled on a first-come, first-served basis. If a service has insufficient enrollment or due to administrative reasons, INVIS reserves the right to cancel the service, require the customer to change courses, or arrange for a postponement.
- Administrative Fees: After a booking is confirmed, if a customer wishes to change the time, location, or content, they must meet the notice period requirements of the relevant prospectus and pay the administrative fee specified by INVIS (refer to the individual service prospectus for specific fees and conditions).
- Agent Role: If the service organizer is not INVIS, INVIS only acts as an agent to handle administrative work. All legal liabilities, terms, and risks of such activities shall be governed by the regulations of the respective organizing institution.
- Payment Deemed as Consent: Once a customer submits an application, booking, or makes any payment to INVIS (regardless of whether a written registration was submitted), it represents that they have carefully read, understood, and agreed to be bound by these terms (including provisions on service expiry, coach assignment, and administrative fees).
- For details on service applications, please visit invis.hk or refer to the relevant prospectus.
4. Payment Policy
- Basis of Charges: All service charges are based on the Final Invoice issued by INVIS. Pricing information on the website, social media platforms, or other promotional materials is for reference only.
- Effective Payment and Quotation Validity:
- Customers must complete full payment in accordance with the terms on the invoice and before the due date.
- Quotation Validity: If payment is not made by the due date, the relevant booking and original quotation will automatically expire and become void immediately. Customers wishing to re-book must submit a new application based on the latest prevailing prices of INVIS at that time.
- Partial payments, overdue payments, or any payments from unidentifiable sources (e.g., failure to provide a payment screenshot or proof) will not be regarded as valid payments.
- Overdue or invalid payments will lead to the automatic cancellation of the booking. All deposits or partial fees paid will be forfeited (voided), and INVIS shall not be held responsible.
- Service Validity and Reactivation Fee:
- All services are subject to a strict usage period. Any services not used within the expiry date will automatically become void, with no refunds, make-up classes, or transfers allowed.
- Service Reactivation: If a customer wishes to reactivate an expired service, it must be approved by INVIS and a designated administrative surcharge must be paid; the validity period of the service after reactivation will be recalculated from the new date.
- Payment Methods: INVIS accepts bank transfers, deposits, cheques, e-cheques, Faster Payment System (FPS), Octopus, cash, purchasing cards, and credit card payments. TEAM INVIS (Cycling Team) services offer additional autopay services.
- Notification Obligation: After payment, customers must retain the receipt and immediately notify INVIS (by providing the payment record or screenshot). If INVIS is unable to identify the payment due to the customer’s failure to provide timely notification, the booking will still be regarded as invalid until the customer completes the notification process and receives confirmation.
- Returned Cheques and Administrative Costs: If any bank charges or administrative expenses are incurred by INVIS due to returned cheques (e.g., insufficient funds) or failure of other payment methods, the customer must fully compensate for the relevant costs.
- For detailed information on payment methods, please visit invis.hk or refer to the relevant prospectus.
5. Change, Cancellation, Refund, and Make-up Policy
- No Refund Policy: Once a service application is accepted and confirmed by INVIS, no requests for cancellation, transfer, or refund will be accepted for any reason, except in cases where the service quota is full or the organizer cancels the event.
- Service Changes and Administrative Fees: After payment confirmation, any changes to a booking (including but not limited to date, time, location, or service content) shall be subject to a designated administrative fee (refer to the relevant service prospectus for details). All change applications must be submitted within the specified notice period; otherwise, they will not be processed.
- Definition of Absence and Forfeiture: All requests for cancellation or change of booking will be regarded as customer absence and automatic forfeiture unless written approval is obtained from an authorized INVIS representative. Absentee participants will not be granted changes, make-up classes, or refunds, and all paid fees will be fully forfeited.
- Make-up Class Arrangements:
- If a make-up class is approved, the time, location, and assigned coach (requests for specific coaches are not accepted) shall be determined solely by INVIS.
- Confirmed make-up class times cannot be changed again. Those who are absent from a make-up class will be regarded as having forfeited the session automatically and will not be granted a second make-up.
- It is the customer’s responsibility to proactively contact INVIS or use the online system to reschedule the make-up class.
- 90-Day Deadline and Reactivation Fee:
- All approved changes or make-up classes must be completed within 90 days from the original service date; otherwise, they will automatically expire and be regarded as forfeiture.
- If a customer wishes to reactivate an expired right for change/make-up, it must be approved by INVIS and the administrative surcharge must be paid. The validity period of the relevant service will be recalculated from the date of reactivation.
- Special Refund Applications: In extreme circumstances, if INVIS considers a refund at its sole discretion, the customer must complete and submit the official “Refund Application Form.” INVIS reserves the right of final audit and refusal, and may deduct any incurred administrative expenses.
6. Administrative Fees for Changes
- General Principle: In principle, INVIS service bookings are non-changeable. Should INVIS, at its sole discretion, accept a customer’s application for change, the customer must pay the relevant administrative fees.
- Fee Standard (Applicable to courses, training, and all services):
- General Change Fee: An administrative fee of $150 is required for each change per service item.
- Special Administrative Fee: A fee of $250* applies if any of the following conditions are met:
- The change is requested within 7 days before the original service date; OR
- The validity period of the original booking has already expired.
- Validity Recalculation:
- *Upon payment of the $250 Special Administrative Fee, the validity period of the service will be recalculated from the date of payment (typically an extension of the original period; please refer to specific prospectuses for details).
- If an expired service is not reactivated by paying the administrative fee within the period specified by INVIS, the service will be deemed permanently void, with no refunds or transfers allowed.
- Coach Assignment Right: For all service changes or make-up classes, INVIS reserves the final decision-making power regarding coach assignment. Except for specific items with additional surcharges, customers are not permitted to specify a coach. INVIS reserves the right to replace coaches at any time for administrative or operational needs, and such changes shall not be regarded as a modification of service content.
7. General Cycling Training and Activity Provision Policy
- Activity Environment: Customers (or their parents/guardians) acknowledge and agree that INVIS services may be conducted in public places, roads, cycle tracks, or carriageways under the supervision of a representative.
- Operational Adjustment Disclaimer: Due to operational, administrative, coaching logistics, or venue reasons, INVIS reserves the final right to change service times, locations, or coach assignments at any time. As long as INVIS provides an equivalent service, it shall not be regarded as a breach of contract, and no compensation of any form will be provided.
- Coach Assignment: Except for specific premium items with additional fees, all coaches are assigned by INVIS. INVIS reserves the right to replace coaches at any time without prior notice. Customers may not request refunds or compensation on these grounds.
- Adverse Weather: Services are governed by the “Service Arrangements Under Adverse Weather.” Authorized INVIS representatives have the right to decide on service changes or cancellations based on actual on-site conditions.
- Overtime Charges: If the service time exceeds the scheduled duration by more than 15 minutes due to the customer’s request or reasons, it will be charged as one (1) additional session.
- Identity Verification: Services are limited to the registered participant only; substitution by others is strictly prohibited. Customers may not change classes without authorization. If discovered, INVIS has the right to immediately terminate their participation without refund.
- Lateness and Interruption:
- Lateness: If a customer is late by 15 minutes or more, the INVIS representative has the right to leave. This will be regarded as customer absence and automatic forfeiture, with no refund or make-up class provided.
- Interruption: Once the service has commenced, no refunds or make-up classes will be provided even if the session is shortened or cancelled midway due to personal reasons of the customer, sudden weather changes, or venue factors.
- Class Discipline: If a customer’s behavior affects others, or if their individual ability or physical fitness fails to keep up with the course progress, the INVIS representative has the right to request the customer to terminate the lesson immediately. INVIS may arrange for the remaining hours to be transferred to other suitable courses, but no make-up classes, compensation, or refunds will be arranged.
- Equipment and Gear:
- Personal Equipment: Customers must ensure their personal equipment complies with safety regulations. If the equipment is substandard, INVIS has the right to refuse participation without refund or make-up class.
- Borrowed Equipment: Customers must use equipment borrowed or rented from INVIS with care. In case of damage, the customer shall bear the full cost of repair or replacement.
- Health and Insurance:
- Customers must assess their own physical condition; INVIS shall not be held liable for any consequences resulting from the customer’s health issues.
- INVIS has purchased basic “Group Accident Insurance” and “Public Liability Insurance,” but strongly recommends that customers purchase additional insurance based on their individual needs.
- Regulations and Codes: Customers must follow the instructions of INVIS representatives, respect other road users, and comply with local government laws and venue regulations.
- Custody of Property: Customers must take care of their personal property. INVIS shall not be held responsible for any loss or damage.
8. Private Member Cycling Activities (“Club Rides”)
- Nature of Activity: TEAM INVIS encourages members to cycle together to foster camaraderie. Members may organize informal cycling activities (referred to as “Club Rides”) from time to time.
- Unofficial Activity Disclaimer: “Club Rides” are strictly private gatherings and spontaneous actions among members. They do not constitute official training, courses, or official activities of INVIS.
- No Agency Rights: Activities initiated, booked, or organized by members among themselves do not represent the stance of TEAM INVIS or INVIS. Unless an activity is officially announced through INVIS official platforms (such as the website or official social media accounts) with a formal registration requirement, all other activities shall be regarded as unofficial private events.
- Assumption of Risk and Waiver:
- Members are free to join “Club Rides” without registering with INVIS.
- Participants must personally assess and assume all risks associated with joining “Club Rides” (including but not limited to traffic accidents, physical discomfort, or equipment damage).
- Participants agree to waive and release INVIS, all sponsors, supporting organizations, and any affiliated entities from any legal liability for illness, injury, death, or property loss caused by any reason (including negligence) arising from participation in “Club Rides,” and further waive any rights to claims or legal actions.
9. Safety Regulations and Obligations
- Acknowledgement of Risk: While cycling is enjoyable, its inherent risks can lead to serious injury or even death. INVIS upholds “Safety First” as its service mission, but customers must understand that sports risks cannot be entirely eliminated.
- Safety Information: INVIS provides various safety information on its official website invis.hk. Customers have the responsibility to review and understand the relevant safety guidelines before participating in any activities.
- Mandatory Protective Gear:
- During cycling, customers must wear protective gear that meets safety standards (including but not limited to cycling helmets).
- INVIS coaches or authorized representatives have the right to immediately refuse service to any customer who refuses to wear appropriate protective gear, without providing any refund or make-up class.
- Disclaimer: If a customer participates in activities without wearing or correctly using protective gear (regardless of whether this is tacitly permitted by the on-site representative), it represents that the customer voluntarily assumes all consequences arising therefrom. The customer hereby agrees to waive all rights to legal claims or actions against INVIS and its representatives.
- Capacity Limits and Safety Ratios: To ensure service quality and safety, INVIS has established strict coach-to-student ratios and capacity limit policies (please refer to invis.hk for details). INVIS reserves the right to adjust activity capacity or terminate excess participation at any time for safety reasons.
10. Statement on Image Recording, Surveillance, and Use of Portrait Rights
- Safety Surveillance: To ensure service quality and operational safety, INVIS may install recording equipment for monitoring and recording purposes at service premises or on related vehicles. Such recordings are strictly for internal safety or regulatory purposes and will not be disclosed to the public.
- Activity Recording and Portrait Rights:
- INVIS coaches or authorized representatives may take photos or videos during service provision. Customers (and students) agree to and authorize INVIS to use their portraits, images, and voices for activity organization, publicity, and promotional purposes.
- Cancellation of Authorization: If a customer wishes to cancel the above authorization, it must be specified in writing at the time of service application.
- Accidental Capture and Disclaimer:
- INVIS understands that some customers may not wish to be photographed. INVIS undertakes to use its best efforts to avoid including relevant individuals during filming and use of images, where permitted by law and operational records.
- Best Effort to Rectify Without Commitment: If a customer finds that their portrait has been accidentally captured in promotional materials against their wishes, they may request INVIS for a replacement or removal. INVIS will use its best efforts to assist in rectifying or taking down the material within a reasonably practicable operational and technical scope; however, this arrangement does not constitute any legal commitment, compensation obligation, or contractual guarantee.
- Customers acknowledge that in large-scale events, open competitions, or group training, the risk of accidental capture, background inclusion, or the inability to completely remove individual portraits is unavoidable. INVIS shall not bear any legal liability arising therefrom.
- Third-party Recording: INVIS is not responsible for any images or data taken and published by other customers or third parties during activities.
11. Personal Information Collection Statement (PICS)
- Purpose of Collection and Mandatory Nature: Personal data provided by customers is primarily used for processing account registrations, service applications, identity verification, and related administrative work. Failure to provide all necessary information may result in delays, inability to process, or rejection of the relevant application.
- Data Transfer and Agency Services: If a customer registers for services provided by other organizers (rather than directly by INVIS), it represents that the customer agrees to and authorizes INVIS to provide their necessary personal data to the relevant organization.
- Direct Marketing and Promotion: INVIS will only use a customer’s personal data for the promotion/marketing of memberships, recreation and sports news, courses, seminars, conferences, activities, and competitions organized by INVIS or its partners with the customer’s consent or indication of no objection.
- Access, Update, and Opt-out:
If a customer does not wish INVIS to continue using their personal data for the aforementioned promotional purposes, or needs to inquire about/update their personal data, please notify us through the following method:- Email the customer’s name and customer number to info@invis.hk (Please state “Opt-out from Promotional Use of Personal Data” in the email subject line).
12. Limitation of Liability and Waiver
- Acknowledgment of Sporting Risks: The primary services provided by INVIS (such as cycling training, races, activities, and rentals) involve inherent risks. Customers acknowledge and agree that cycling, regardless of the level of proficiency, may lead to injury, permanent disability, or even death due to personal negligence or the negligence of others.
- Assumption of Risk Statement: Participants, their parents, guardians, or responsible persons should assess the relevant risks beforehand. By registering, making payment, or participating in INVIS services, you represent that you understand and are willing to personally assume any consequences resulting from accidents (including but not limited to medical expenses, property loss, and injury or death).
- Insurance Recommendations: Although INVIS may have purchased basic insurance, such coverage may not meet all individual needs. INVIS strongly recommends that customers purchase additional personal accident, medical, and property insurance based on their individual circumstances.
- Legal Waiver and Release of Claims:
- Customers warrant that their participation is voluntary and that they are in good health.
- The customer, their heirs, executors, and administrators hereby unconditionally waive and release “INVIS HK COMPANY LIMITED,” all sponsors, supporting organizations, and relevant personnel from any legal liability for illness, death, personal injury, or property loss caused by any reason (including but not limited to negligence) arising from participation.
- Customers agree to waive any rights to claims or legal actions in any form.
- Third-party Acts: INVIS shall not be held liable for any compensation regarding accidents caused by the acts of other participants, road users, or third parties.
13. Miscellaneous
- Non-Waiver Statement: Any failure or delay by INVIS in exercising or implementing any right contained in these terms shall not be deemed a waiver of that right, nor shall it affect the right of INVIS to take subsequent action to pursue that right or any other rights.
- Severability: If any provision of these Terms and Conditions is found to be invalid or unenforceable by any court or administrative body of the Hong Kong Special Administrative Region, the invalidity or unenforceability of such provision shall not affect the other provisions of these Terms and Conditions. All provisions not affected by such invalidity or unenforceability shall remain in full force and effect.
- Language Discrepancy: The content of these terms is written in Chinese. The translated version (if any) is for reference only. In the event of any discrepancy between the Chinese and English versions, the Chinese version shall prevail.
- Right to Amend and Final Interpretation: INVIS reserves the right to modify, update, and interpret all the above terms at any time without prior notice. In the event of any dispute, INVIS reserves the right of final decision.
